Terms of Service

1. Acceptance of Terms

By creating an account or using Passmark ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These terms are governed by the laws of England and Wales.

2. Description of Service

Passmark is a digital platform that enables:

• Approved Driving Instructors (ADIs) to log lesson fault data, generate AI-powered lesson plans, and manage their learner cohort.
• Learners to view their driving readiness scores, access lesson plans, and find instructors.

Passmark is a data tool only. We are not a driving school, and we do not provide driving instruction services.

3. Eligibility

You must be at least 16 years old to use Passmark as a learner. Instructors must be DVSA-registered ADIs or PDIs. By registering, you confirm that the information you provide is accurate and that you meet these requirements.

4. Account Responsibilities

You are responsible for:

• Keeping your account credentials secure and confidential
• All activity that occurs under your account
• Ensuring the accuracy of lesson data and fault logs you submit
• Not sharing your account with any other person

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit false or fabricated fault or lesson data
• Attempt to reverse-engineer, scrape, or exploit the platform
• Harass or misrepresent other users
• Upload malicious code or attempt to compromise platform security

6. AI-Generated Content

Lesson plans and behavioural pattern summaries are generated using artificial intelligence (Google Gemini). These are provided as guidance only. Passmark makes no warranty as to the accuracy, completeness, or suitability of AI-generated content. Instructors remain solely responsible for the quality of instruction they deliver.

7. Intellectual Property

All content, design, and code within the Passmark platform is owned by Baulin Technologies. You are granted a limited, non-transferable licence to use the Service for its intended purpose. You may not copy, distribute, or create derivative works without our written consent.

Data you submit (lesson logs, notes) remains yours. By submitting it, you grant us a licence to process and store it for the purposes of providing the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Passmark is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you will not exceed the amount you have paid us in the 12 months prior to the claim.

We do not guarantee that using Passmark will result in passing a driving test.

9. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms. You may delete your account at any time through your account settings.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
